Common questions
What counts as a serious offence in Nigeria?
In the southern states the Criminal Code calls an offence punishable by three years in prison or more a felony. The Penal Code states, including the Federal Capital Territory, use their own classification. For offences punishable with death, bail is only granted by the High Court in exceptional circumstances.
Do I have a right to a lawyer at trial?
Yes. The Constitution guarantees a fair hearing within a reasonable time and the right to defend yourself in person or through a lawyer of your choice. The earlier a lawyer is involved, the better the evidence and the witnesses can be protected.
