Common questions

When is a court bail application needed?

When the person has been charged to court, when the police will not grant bail, or when the offence is one the police cannot grant bail for. The application is made to the magistrate or the High Court depending on the charge.

What conditions can a court set for bail?

Commonly one or more sureties, a bail sum, surrender of a passport, reporting to the police or the court on set days, and staying away from witnesses. The lawyer proposes conditions the person can meet and lines up acceptable sureties in advance.

How long does it take?

It depends on the court and its list. An application can sometimes be heard within days; the lawyer tells you what to expect in your case and keeps you informed at each stage.
